Professor Bryant’s article – which seeks to discover whether aspects of an anticruelty statute can be based directly on a call to virtuous conduct – is a provocative piece of scholarship that harbors a much larger question: Can a general principle mandating full respect for animals be developed out of the moral methodology inhering in virtue ethics? Insights garnered in this rejoinder are meant to stand alongside those in Professor Bryant’s article to lend deep moral grounding to animal-respect as well (...) as provide intimations of the way virtue ethics as a moral methodology might yield determinate answers to moral questions. Toward this end, this paper has several sections. The first section briefly outlines virtue ethics as a moral methodology with particular attention to its highly situated and somewhat ad hoc aspect. The second section explores efforts over the last several decades to rely first on utilitarianism and then on deontological approaches in pursuit of moral grounding for animal respect. The third section explores the particular challenges that utilitarianism or deontology must confront in attempting to provide moral grounding for any relationship between human beings and persons or creatures that are incapable of moral agency. Finally, I turn to the concept of fiduciary duty to see if it might be viewed as a type of virtue ethics – or perhaps an instance of virtue ethics in play. (shrink)

This essay explores the value of oppositional, performative political action in the context of oppression, domination, and exclusionary political spheres. Rather than adopting Iris Marion Young's approach, Drexler turns to Hannah Arendt's theories of political action in order to emphasize the capacity of political action as action to intervene in and disrupt the constricting, politically devitalizing, necrophilic normalizations of proceduralism and routine, and thus to reorient the importance of contestatory action as enabling and enacting creativity, spontaneity, and resistance.

Is it possible for postmodernism to offer viable, coherent accounts of ethics? Or are our social and intellectual worlds too fragmented for any broad consensus about the moral life? These issues have emerged as some of the most contentious in literary and philosophical studies. In Renegotiating Ethics in Literature, Philosophy, and Theory a distinguished international gathering of philosophers and literary scholars address the reconceptualisations involved in this 'turn towards ethics'. An important feature of this has been a renewed interest in (...) the literary text as a focus for the exploration of ethical issues. Exponents of this trend include Charles Taylor, Bernard Williams, Iris Murdoch, Cora Diamond, Richard Rorty and Martha Nussbaum, the latter a contributor and a key figure in this volume. This book assesses the significance of this development for ethical and literary theory and attempts to articulate an alternative postmodern account of ethics which does not rely on earlier appeals to universal truths. The first is the story of four friends who came up to Oxford together just before WWII. It is the story of their lives, loves, and intellectual preoccupations; it is a story about women trying to find a place in a man's world of academic philosophy. The second story is about these friends' shared philosophical project and (...) their unintentional creation of a school of thought that challenged the dominant way of doing ethics. That dominant school of thought envisioned the world as empty, value-free matter, on which humans impose meaning. This outlook treated statements such as “this is good” as mere expressions of feeling or preference, reflecting no objective standards. It emphasized human freedom and demanded an unflinching recognition of the value-free world. The four friends diagnosed this moral philosophy as an impoverishing intellectual fad. This style of thought, they believed, obscured the realities of human nature and left people without the resources to make difficult moral choices or to confront evil. As an alternative, the women proposed a naturalistic ethics, reviving a line of thought running through Plato, Aristotle, and Aquinas, and enriched by modern biologists like Jane Goodall and Charles Darwin. In Gendered Readings of Change, Clara Fischer develops a unique theory of change by drawing on American philosophy and contemporary feminist thought. Via a select history of ancient Greek and Pragmatist philosophies of change, she argues for a reconstruction of transformation that is inclusive of women's experiences and thought. With wide-ranging analysis, this book addresses ontological, moral, epistemological, and political questions, and includes an insightful exploration of the philosophies of Parmenides, Aristotle, John Dewey, Iris Young, and Jane Addams.

Similarities between pragmatist models of democracy and deliberative models have been explored over recent years, most notably in this journal ( Talisse 2004). However, the work of Iris Marion Young has, thus far, not figured in such comparative analyses and historical weighing of pragmatist antecedents in deliberativist work. In what follows, I wish to redress this oversight by placing Young in conversation with John Dewey and Jane Addams. Young's particular brand of deliberative theorizing focuses on the inclusion of (...) women and all those deemed Other in our democracies. She identifies a significant shortcoming in standard expositions of deliberative thought, pointing out that communicative style, structured by oppressive norms of gender, race, and class, to name but a few, may serve to undermine our full participation in political decision making. While this forms a valuable insight for those seeking to redress the exclusion of Others in democracies, it also draws attention to the centrality of differences of communication in deliberative settings. In what follows, I will highlight the integral role played by communication in Young's and Dewey's expositions of democracy while showing that Addams foreshadows Young's principal insight through an appreciation of communicative difference and its attendant political implications. This paper examines potential ethical and legal issues arising during the research, develop- ment and clinical use of a proposed strategy in personalized medicine (PM): using human induced pluripotent stem cell (iPSC)-derived tissue cultures as predictive models of individ- ual patients to inform treatment decisions. We focus on epilepsy treatment as a likely early application of this strategy, for which early-stage stage research is underway. In relation to the research process, we examine issues associated with biological samples; data; health; vulnerable (...) populations; neural organoids; and what level of accuracy justifies using the iPSC-derived neural tissue system. In relation to clinical use, we examine potential uses in pre-natal screening, and effects on clinical decision-making. Although our focus is providing recommendations for researchers developing work in this area, we identify the novel issue of deciding on an acceptable accuracy level for the system. We also emphasize an issue thus far neglected in the ethics of PM: PM tends to represent treatment decisions as though they should be directed solely by biomedical information, but this in itself could be detri- mental to best personalizing treatment decisions in the clinic. In 1936 Tarski sketched a rigorous definition of the concept of logical consequence which, he claimed, agreed quite well with common usage-or, as he also said, with the common concept of consequence. Commentators of Tarski's paper have usually been elusive as to what this common concept is. However, being clear on this issue is important to decide whether Tarski's definition failed (as Etchemendy has contended) or succeeded (as most commentators maintain). I argue that the common concept of consequence that Tarski (...) tried to characterize is not some general, all-purpose notion of consequence, but a rather precise one, namely the concept of consequence at play in axiomatics. I identify this concept and show that Tarski's definition is fully adequate to it. (shrink)

Clinical ethics consultants (CECs) often face some of the most difficult communication and interpersonal challenges that occur in hospitals, involving stressed stakeholders who express, with strong emotions, their preferences and concerns in situations of personal crisis and loss. In this article we will give examples of how much of the important work that ethics consultants perform in addressing clinical ethics conflicts is incompletely conceived and explained in the American Society of Bioethics and Humanities Core Competencies for Healthcare Ethics Consultation and (...) the clinical ethics literature. The work to which we refer is best conceptualized as a specialized type of interviewing, in which the emotional barriers of patients and their families or surrogates can be identified and addressed in light of relevant ethical obligations and values within the context of ethics facilitation. This paper is based on case-study research in four English secondary schools. It explores the pressure placed on English and mathematics departments because of their results being reported in annual performance tables. It examines how English and maths departments enact policies of achievement, the additional power and extra resources the pressure to achieve brings and the possibility of resistance.

Racially restrictive marriage laws lay at the intersection of state claims of domestic sovereignty and federal obligations to protect the constitutional rights of citizens. In 1948, California overturned its antimiscegenation law, citing, in addition to the Fourteenth Amendment, the United Nations Charter. This decision sparked a contentious discussion about the relationship of human rights norms to racial conventions in the United States, and triggered a debate about the peril of international law that resulted in an effort to amend the Constitution (...) and limit the treaty-making powers of the president. Both the constitutional and the international logics of individual human rights threatened local custom and energized political opposition. American stigmatization of international human rights norms and treaties was rooted directly in the civil rights struggles in the United States and reflected the potential of international organizations to assault domestic racial conventions at their foundations. The banner of deliberative democracy is attracting increasing numbers of supporters, in both the world's older and newer democracies. This effort to renew democratic politics is widely seen as a reaction to the dominance of liberal constitutionalism. But many questions surround this new project. What does deliberative democracy stand for? What difference would deliberative practices make in the real world of political conflict and public policy design? Sunstein, Michael Walzer, and Iris Marion Young, and the editor of the volume, Stephen Macedo. The book concludes with a thoughtful response from Gutmann and Thompson to their esteemed critics. Diagrams make it possible to present scientific facts in more abstract and generalized form. While some detail is lost, simplified and accessible knowledge is gained. E. B. Wilson's work in cytology provides a case study of changing uses of diagrams and accompanying abstraction. In his early work, Wilson presented his data in photographs, which he saw as coming closest to “fact.” As he gained confidence in his interpretations, and as he sought to provide a generalized textbook account of cell development, (...) he relied on increasingly abstract diagrams. In addition, he came to see that highly abstract and even schematic drawings could provide more than pictures directly from life. (shrink)

References to strength of mind, a character trait implying “the prevalence of the calm passions above the violent”, occur in a number of important discussions of motivation in the Treatise and the Enquiry concerning the Principles of Morals. Nevertheless, Hume says surprisingly little about what strength of mind is, or how it is achieved. This paper argues that Hume’s theory of the passions can provide an interesting and defensible account of strength of mind. This paper adapts Kuhn’s conceptual framework to developmental episodes in the theory and practice of medicine. Previous attempts to understand the reception of Ignaz Semmelweis’s work on puerperal fever in Kuhnian terms are used as a starting point. The author identifies some limitations of these attempts and proposes a new way of understanding the core Kuhnian notions of “paradigm,” “progress,” and “revolution” in the context of a socially embedded technoscience such as medicine.

In this article we explore the ways in which the notion of the imagination might be mobilized to support researchers to develop transgressive research imaginations and communities with the capacities to think, 'be' and 'become' differently in a world of research increasingly governed by rampant reductionist rationality. To assist us we draw from the evocative views of imagination developed by Cornelius Castoriadis, the imagination's most radical exponent. In this article his ideas about knowledge and its links to the imagination will (...) be deployed as we discuss the following questions: What does the notion of the imagination mean in the everyday world of university research? Is all research an act of the imagination? What might it mean to globalize the research imagination? Svrha i cilj ovog članka sastoji se u pokušaju ukazati na važan doprinos Karola Wojtyle razvoju dijaloga između klasične filozofije i moderne misli, te klasične filozofije i znanosti, posebice na području etike.Pritom se analize oslanjaju poglavito na dio »Lublinskih predavanja« naslovljenih 'Čin i doživljaj' koja je Wojtyla kao mladi docent držao tijekom 1954/55. godine na Filozofskom fakultetu Katoličkog sveučilišta u Lublinu. Ta su predavanja paradigmatična za Wojtylin dijalog sa suvremenom mišlju i znanošću. U njima se Wojtyla bavi razlikom između psihologijskih (...) i etičkih analiza volje kako bi razjasnio strukturu etičkog čina. Temeljem usporedne analize pozicije modernog pravca eksperimentalne psihologije volje i shvaćanja koja susrećemo u Tome Akvinskog, Wojtyli je uspjelo ukazati ne samo na moguće konvergentne točke između tih analiza, nego i na razlike koje su neizbježne. Njegov dijalog sa koncepcijom modernog pravca psihologije volje bio je plodan za osvjetljavanje značenja metafizičke koncepcije volje Tome Akvinskog kao i za razmatranje problema razdvajanja doživljaja i čina u etičkim teorijama I. Kanta i M. Schelera.Ziel und Zweck dieses Artikels liegen in dem Versuch, auf den wichtigen Beitrag Karol Wojtylas zur Entwicklung des Dialogs zwischen der klassischen Philosophie und des modernen Denkens, sowie zwischen der klassischen Philosophie und der Wissenschaft, besonders auf dem Gebiet der Ethik, hinzuweisen.Die Analysen stützen sich vor allem auf den Teil der Lubliner Vorlesungen mit dem Titel Akt und Erlebnis, die er als junger Dozent an der Philosophischen Fakultät der Katholischen Universität Lublin hielt. Diese Vorlesungen sind paradigmatisch für Wojtylas Dialog mit dem modernen Denken und der Wissenschaft. In diesen Vorlesungen befasst sich Wojtyla mit den Unterschieden zwischen den psychologischen und philosophischen Analysen des Willens, um die Struktur des ethischen Aktes zu erklären. Aufgrund der komparativen Analyse der Position der modernen Richtung der eksperimentellen Willenspsychologie und der Auffassungen, denen wir bei Thomas von Aquin begegnen, gelang es Wojtyla nicht nur auf mögliche konvergente Punkte zwischen diesen Analysen hinzuweisen, sondern auch auf die Unterschiede, die unausweichlich sind. Wojtylas Dialog mit der Konzeption der modernen Richtung der Willenspsychologie war fruchtbar sowohl für die Erhellung der Bedeutung der metaphysischen Konzeption des Willens von Thomas von Aquin, als auch für die Erörterung des Problems der Trennung von Erlebnis und Akt in den ethischen Theorien von I. In this essay I consider, by way of the reflections of accomplished synthetic chemists, how the experimental work of the synthetic organic chemist supports the testing, refinement, and creation of theories of organic chemistry. The role of experiments in modern Baconian sciences like organic chemistry is contrasted with their role in fields of more traditional philosophical concern, such as experimental physics.

A generation before Beardsley, legal scholar John Henry Wigmore invented a scheme for representing arguments in a tree diagram, aimed to help advocates analyze the proof of facts at trial. In this essay, I describe Wigmore's "Chart Method" and trace its origin and influence. Wigmore, I argue, contributes to contemporary theory in two ways. His rhetorical approach to diagramming provides a novel perspective on problems about the theory of reasoning, premise adequacy, and dialectical obligations. Further, he advances a novel solution (...) to the problem of assessing argument quality by representing the strength of argument in meeting objections. (shrink)

Anton Dohrn rejected the popular Amphioxus-ascidian theory of vertebrate origin, which saw Amphioxus as the most primitive vertebrate and ascidians as vertebrate ancestors. Instead he argued for the segmented annelids as the more likely candidate. Attacked for being 'unscientific' by such popular morphologists as Carl Gegenbaur and Ernst Haeckel, Dohrn countered with similar accusations. Since the debate peaked as Dohrn was establishing his Stazione Zoologica in Naples at the end of the nineteenth century, it gained him valuable attention and may (...) have encouraged him to retain his view even in the face of new and problematic evidence. This paper explores Dohrn's contributions and the underlying commitments revealing what he regarded as important in science. (shrink)

This paper argues that public sector organizational failure may be best understood from a perspective of collective denial. The rise of this phenomenon is examined using testimony from a Public Inquiry into the downfall of a UK hospital, where falling organizational standards led to unethical decision making and an unacceptable number of patient deaths. In this paper, we show how collective denial, over time, became a process that resided within the fabric of organizational life. To explore the organizational processes associated (...) with collective denial, and how and why it occurs, we identify the influence of a ‘narrative of silence.’ This narrative allows ever more serious failings to be justified as organizational members lose contact with reality entering a downward spiral with no recovery. The combined impact of assumptions about leadership capability, enculturated professional identities, and organizational loyalty create an environment where a narrative of silence can develop. Although dualism has the advantage of being intuitively plausible, it is not compatible with a 21st-century (scientific) world view. Jaak Panksepp and Antonio Damasio are contemporary writers who reject dualism, and whose views take the form of “biological naturalism”. I first discuss how their views compare in five specific respects; and then I look more closely at how the different emphases of the views affect their ability to account for the evolutionary advantages of consciousness, specifically. Both authors agree that “consciousness” (...) provides creatures with a survival advantage in terms of their ability to produce novel and/or flexible responses, their ability to plan ahead, and their motivation to promote their own survival – but the exact means by which they think these advantages are conferred, in each of these respects, differ. One might say that, whereas Damasio thinks the main evolutionary advantages of “consciousness” (the “higher reaches” of which are unique to humans) have to do with enabling creatures to work out what to do to promote their well-being, Panksepp thinks the main advantage of “consciousness” is that being “conscious” of affective feelings urgently motivates creatures to take action when their well-being is threatened. Considering that “working out what do” is only possible for a small selection of cognitively sophisticated organisms, I argue that Panksepp’s account is more plausible than Damasio’s account. (shrink)
